Central Florida (Affiliated Agency Settlement)
The Florida Department of Financial Services (DFS) entered a recent Consent Order with Fidelity
National Title Insurance Company (FNTIC). This Consent Order was entered into in response
to an ongoing investigation by DFS into the common Florida practice of the formation of
affiliated business arrangement title insurance agencies with real estate companies. FNTIC,
along with most other closing offices in Florida, had established title agencies with these
types of customers in a manner that we believed were compliant both with Real Estate
Settlement Practices Act (RESPA) and with Florida anti-rebate statutes. However, the
Florida Department of Financial Services, after completing its investigation, felt that our
title agency arrangements were not compliant with the Florida statute. As a show of good
faith, FNTIC voluntarily agreed to cancel all of these title agencies and refund back to
the consumer that portion of the premium that was retained by the title agency. In addition,
we stipulated to a $1 million fine. FNTIC felt that it was in the best interest of the
company and our customers to resolve this matter quickly and move forward in a positive
manner to set the standard as the leading title insurance company in the Florida market.
You do not have to file an inquiry to receive a refund. If you are eligible for a refund, it
will be sent to you automatically.
However submitted, your information will be provided to the independent audit firm for review
to determine whether you are eligible for a refund under the consent order with the DFS. A
refund will depend on when and where you closed and whether you were the buyer or seller. If
you are eligible you will receive your refund check by January 22, 2006. Thank you.
